The agreement covers the use of the websites madridchauffeur.com and peninsularchauffeur.com which are trading names of ST JAMES TOUR MANAGEMENT SERVICES SL ( CIF: B10530368) and in that using this site, whether directly or through third parties you agree to be bound by the following obligations:

In making a booking (which includes an enquiry), you agree that these terms and conditions apply. "You" means the person who has completed the booking and each and every member of the group on whose behalf that person has booked with us including as when booking through third party agents.

• You accept financial responsibility for all bookings in your name or account.
• You must make sure that all your information is true and accurate at all times.
• You must not use this site for an improper purpose, including but not limited to making speculative, false or fraudulent bookings.
• You must behave, at all times, in a safe and courteous manner and compensate us or our providers for any damage caused by you during the use of vehicles and services provided by parties.
• The transmission of threatening, defamatory, pornographic, political or racist material or any material that is unlawful is expressly prohibited.
• The site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed, or reproduced in any way by you unless with specific authorisation.

2. Agency
A – Madridchauffeur/Peninsularchauffeur.com acts as agent for third party service providers (the “providers”). What this means is that the contract for the service is between you and the provider and unless expressly stated otherwise, we have no contractual liability to you in respect of that service as all rights and remedies are against the providers. This may mean that there are additional terms and conditions governing the contract as each provider will have terms and conditions relating to that service. Nothing in these terms and conditions is designed to give any other person any rights or remedies.
All services sold through Madridchauffeur/Peninsularchauffeur.com are not an offer by Madridchauffeur/Peninsularchauffeur.com to sell any service, but an invitation to you to make an offer to our providers. We are free to accept that offer on behalf of the providers or to reject it. If your booking is accepted, we will send you an e-mail confirming the contract upon receipt of payment in accordance with the payment conditions in Clause 4 (Bookings).

B - Where bookings are made through third party agents the providers of Madridchauffeur/Peninsularchauffeur.com are to be considered exclusive and no representation may be made directly for any purposes.

3. Booking details
Madridchauffeur.com com may pass your booking details to the relevant providers. The making of a booking by you will constitute consent to us passing on such personal information. You undertake to us that the details you give to us while using the site are correct and that there are sufficient funds to cover the cost of the booking. If there are any changes to the personal details supplied to us by you, it is your responsibility to notify Madridchauffeur/Peninsularchauffeur.com by contacting us promptly as detailed in Clause 4 (Variations) below.

4. Bookings
Once you have made a booking on the site, we will contact the providers to pass on the details and to obtain confirmation that they are able to fulfil your booking. In the event that they are unable to fulfil your booking, we will notify you and suggest an alternative provider that can provide a similar service. At all times, we will endeavour to contact you within 48 hours of you making your booking.

A - Deposit and Payment Conditions
A deposit of 20% of the total booking value maybe payable when you complete your booking on-line. The balance (80%) of the total booking value is payable no less than 24 hours before the service is scheduled to take place unless otherwise specified. On receipt of final balance the confirmation itinerary is sent detailing all activities and matters. If final balance payment is not received within 1 week or as otherwise specified the booking is considered to be cancelled.

B - Variations
Once a booking has been completed and processed, variations such as additions or deletions to your group, changes to the time and date, will only be permitted at the discretion of the provider and/or Madridchauffeur/Peninsularchauffeur.com. Where variations are permitted, you must contact Madridchauffeur.com in writing of such a request as soon as possible and in any event at least 10 days before the event as detailed in your booking confirmation. We retain the right to make alterations or variations to bookings that provide a like for like alternative in the event that this is required to ensure the booking conditions are complied with.

5. Payment conditions
Please note that bookings are made subject to availability, what this means is that we will pass your details onto our providers and we will subsequently contact you to confirm the booking. Please note that no contract is formed until we have contacted you and confirmed the booking upon receipt of payment of the deposit. Package conditions including (without limitation) the date and time, the price, payment terms and information about variations and cancellations are confirmed in writing.
Prices quoted are per service basis including VAT ( IVA) unless stated otherwise, as in the case of prices quoted in Tenerife, Gibraltar or otherwise. Payment shall be by credit card or bank transfer to the account number specified in your confirmation.

6. Refund policy
If you wish to cancel your booking, please contact us at info@madridchauffeur.com/info@peninsularchauffeur.com as soon as possible as detailed in your booking confirmation. Depending on the date of cancellation, the following cancellation charges will apply:

More than 3 days before the event is scheduled to take place 50% of the total cost of the event
Less than 3 days before the event is scheduled to take place 100% of the total cost of the event

We try where possible to refund for services which have been booked and monies paid to providers and partners, however this is not always possible as for example the case of prepaid service. In this case the refund will receive only monies recovered.

Wherever possible we seek to make discretionary refund offers which must be agreed within 30 days of offer with acceptance and signed refund agreement received by said date or be forfeited.

a- Partial Cancellations
In the event of cancellation of part of a service then the cancellation charges outlined above apply pro rata but we may become entitled to cancel the service.
This may necessitate a further payment by you to pay the difference between the discounted price and the revised price.

7. Force Majeure
Force Majeure includes war, riot, civil unrest, strike, industrial dispute, terrorist activity, natural or industrial disaster, fire, adverse weather conditions, operational decisions of air carriers such as changes of schedule or any unforeseeable or unavoidable event beyond Madridchauffeur.com's control.

Some of the activities are dependent on weather conditions to ensure the safety of all participants. Where any activity has to be cancelled due to adverse weather, the event will still take place notwithstanding this cancellation. We will do our best to ensure that you are advised in advance and upon request, we will try to reschedule the activity for another time or date if possible. We are not obliged to give any refund if an event is cancelled because of adverse weather conditions or a Force Majeure event.

8. Insurance
All services are full covered by our company liability, driver insurance, including accident according to law in the territories of the service.

9 . No representation
The information, software, products, and services published on this site may include inaccuracies or typographical errors. Changes are periodically made to the site. www.madridchauffeur.com makes no representations about the suitability of the information, software, products and services contained on this site for any purpose.

11. No responsibility
Madridchauffeur.com and its respective providers hereby disclaim any and all liability, all warranties, terms and conditions with regard to this information and the services, including all implied warranties, and conditions, of quality, fitness for a particular purpose, title, and non-infringement. Madridchauffeur.com is not responsible for inaccurate or misleading service descriptions. The information is given in good faith and is consistent with the information supplied by the provider to Madridchauffeur.com.

In no event shall madridchauffeur.com and/or its providers be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or in any way connected with the use of this site or for failure to complete a booking, or for any information and services obtained through this site, whether based on contract, tort, strict liability or otherwise.Except in relation to liability for death or personal injury for which no limit applies.

madridchauffeur.com and/or its respective providers shall only be liable for direct loss you suffer arising out of the use of this site (i) to the extent that we have caused you personal injury, provided that we will not be liable for any loss except to the extent required by law; and (ii) whether based on contract, tort, strict liability or otherwise, up to a maximum of the value of the booking under which the claim arises.

13. Updating of terms and conditions
Madridchauffeur.com reserves the right to vary or update these terms and conditions. www.madridchauffeur.com will notify you of any changes promptly where they affect your booking.

14. Severability
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, without limitation, the warranty disclaimers and liability limitations set out above, then the invalid or unenforceable provision will be deemed to be replaced by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

15. Entire Agreement
This agreement constitutes the entire agreement between the customer and madridchauffeur.com with respect to this site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and madridchauffeur.com with respect to this site. Any rights not expressly granted herein are reserved.

16. Governing law
This agreement is between you and Madridchauffeur.com is governed by the laws of Spain.
